Is mediation right for every family?

No. Mediation is voluntary and may not be appropriate where there are safety concerns, coercion, active protective orders or a significant power imbalance. Every matter begins with a private suitability screening.

Can we mediate before filing for divorce in Arizona?

Yes. Mediation can occur before or after a case is filed. Some matters will still require court filings and judicial approval of any agreement.

Does the mediator represent either of us?

No. The mediator is neutral and does not represent, advise or advocate for either party. Each party may choose to obtain independent legal advice.

What do Legal Decision-Making and Parenting Time mean?

These are the terms Arizona uses. Legal Decision-Making concerns major decisions about a child such as education and health care. Parenting Time is the schedule for when each parent spends time with the child.

Is a therapist automatically part of the process?

No. Therapy is not automatically part of mediation. A Licensed Marriage & Family Therapist participates only where appropriate and separately engaged, and is not the children's therapist unless separately engaged.

Can one attorney represent both of us?

No. An attorney does not represent both spouses. Attorney services, when used, are engaged separately under an appropriate attorney-client relationship.

Is mediation always faster or less expensive than court?

Not always. Many families find mediation more efficient, but outcomes depend on the issues, the level of agreement and each family's circumstances.
